Freedom of Information

The Freedom of Information Act 2000 came into force on 1 January 2005.

Under the Freedom of Information Act 2000, anybody may request information from a public authority which has functions in England , Wales and/or Northern Ireland . The Act confers two statutory rights on applicants:

  • To be told whether or not the public authority holds that information; and if so,
  • To have that information communicated to them.

It enables anybody in the world to have a full reply for information supplied on written request, if it is not exempt, within 20 working days of receipt . It applies to retrospective information. The ethos is to supply all .

Exceptions are:

  • if costs of supplying information exceed £600
  • if it is a repeat or vexatious request
  • if the information you are supplying is planned to be published.

Exemptions are not all so straightforward as many would also be subject to a public interest test. There are 23 exemptions from the rights of access under the FOI Act.

The EMPHO Publication Scheme

The aim of this publication scheme is to set out:

  • What information we publish or intend to publish as a matter of course
  • How this information will be published
  • Whether the information will be available free of charge or on payment.

Our intention is to publish as much information as possible about ourselves and about the statistical information that we gather.

The publication scheme divides the information published by EMPHO into several broad areas with a number of sub-headings under each.

How to obtain information from EMPHO

Your entitlement to information

From January 2005 you have been able to make requests for specific information under the Freedom of Information Act 2000. However, before doing so, you should ensure that the information is not already publicly available on the website.
